摘要：短期自由刑是指剥夺犯罪人短期自由的刑罚。从19世纪后半期实证学派的产生，短期自由刑就成为了中外刑法学界争论的炙热话题，学者无论对短期自由刑的概念界定，还是其自身存在的利弊以及存废等问题都存在着不同的观点。然而我们应该抱着科学的、正确的态度来评价短期自由刑，一方面要看到它的优势并发扬其优势，另一方面也要发现其弊端并寻找出改革短期自由刑弊端的方法和完善措施，最大限度的发挥短期自由刑的作用，使其成为我们打击犯罪、改造犯罪人的有力武器。

On the short-term free sentence
Abstract：Short of short-term freedom penalty of deprivation criminal punishment of personal freedom. From the second half of the 19th century, theempirical school of thought, of short-term freedom penalty becomes Chinese and foreign criminal law educational world hot topic, scholars regardless of short-term freedom penalty concept definition, and the pros and cons of its own existence as well as the problems such as there are different points of view. However, we think of short-term freedom penalty should have a scientific attitude, on the one hand, to see its advantages and promote its advantages, on the other hand also to find its defects and find ways to overcome its shortcomings, make its maximum play to the education and transform the function of the criminal.
