城管执法的行政法学思考

摘要：现在我国城市管理领域承受很大的管理压力，我们不能忽视城市管理中逐渐暴露的制度上的缺陷,以及在城管执法过程中出现的问题。近年来，各地相关部门对城管执法出现的问题给出了解决方案，对城管暴力执法等现象也产生一定的约束作用，但同时也暴露出一些新的问题，属于治标不治本。通过分析可以发现，城管的行政法地位处于模糊状态，存在职责权限不明的事实，导致其行使权力不规范，与社会民众矛盾突出。城管对社会发挥了巨大的作用。因此，对于城管执法的研究甚为重要。希望通过从行政法角度研究我国城管执法，从多方面对优化和改善城管的行政法地位和执法行为提出建议。34286

Abstract: Now , the field of our city management face a lot of pressure , we can not ignore the defects that exposed on the system in the management and the problems in the law enforcement process .In recent years , all the relevant departments of urban management given solutions about the law enforcement , also have certain constraints on violent law enforcement and other phenomenon . At the same time, some new problems have been exposed , the methods belong to the index is not a cure . The analysis can be found in the status of administrative law inspectors in the fuzzy state .There are responsibilities of unknown facts , the exercise of power is not standardized . Urban management officers play an important role in the society . Therefore , the study of law enforcement is very important . This paper hopes to study China’s urban management and law enforcement from perspectives of administrative law , put forward suggestions from the aspects of the optimizations and improvement of urban management in administrative law enforcement status and behaviors .

   前言
   当前，推进城市化建设的进程正处于关键时期，面对城市管理过程中出现的新问题、新情况，如何完善城管执法体制，从容应对城管执法时碰到的各种问题，国内学者也进行了深入的研究和探索。我国学界目前对城市管理及城管执法的研究领域非常宽广，研究的理论化系统化程度也较高，已经达到了相当的水平，但是，大多以规范研究为主，对城管执法工作缺乏较为全面的了解，使提出的对策缺乏针对性和操作性，因此，相关研究也应当具体去结合实践来完善。城管执法的行政法学思考:http://www.751com.cn/faxue/lunwen_31754.html
