摘 要：互联网在十几年的时间里风行全球，成为全球性传播媒体的佼佼者。但在网络环境下，知识产权的纷争也频繁发生，如何保护好网络知识产权已经成为了亟待解决的时代命题。本论文运用文献研究法、案例分析法以及归纳总结等方法，结合百度文库侵权案，在掌握了网络知识产权特征的基础上，从当前保护网络知识产权的立法执法、意识形态以及技术现状着手分析，进而从互联网本身的特性以及相关法律、技术、道德等层面深入研究网络知识产权屡遭侵犯的原因，并针对网络知识产权的保护提出相关策略，以求促进网络健康发展。6734

Network Protection of Intellectual Property Rights
——Take " Baidu Library infringement case " as an example
Abstract: The Internet has been popular wordwide within more than years, and it has already become the most outstanding global media. However, in the network environment, Intellectual property disputes occur frequently. So how to protect the intellectual property rights has become the era proposition to be settled. This paper is mainly using methods such as literature study, case study and inductive and summary method, combining to the “Baidu Library infringement case”. Making analysis of the current protection of network intellectual property’s legislation and enforcement, ideology and technology situation, based on the characteristics of network intellectual property. And then conclude the deep reasons of network intellectual property rights’ being repeatedly violated from aspects of characteristics of the Internet and related laws, technology and moral. Finally, put forward the related strategies, so as to promote the healthy development of the network for the purposes of this article of protecting intellectual property rights.
