摘要随着我国对外开放的不断深入，国际贸易迅速发展，现行知识产权海关保护制度面临着越来越复杂的执法困惑，对此，指出我国知识产权海关保护现状中的利益冲突现象，深入分析导致这些利益冲突的根本原因，进而提出有针对性的解决办法对于提升我国海关的知识产权保护水平至关重要。在知识产权海关保护中涉及多方面利益，包括国家利益、社会利益、权利人利益和进出口人利益等，既有公权力，也有私权利，既有长远利益，也有眼前利益，因此，在一些复杂的具体问题面前，急需实践利益平衡的原则来达到问题的解决，使我国海关知识产权保护工作更好的发展。45658

知识产权海关保护的利益平衡机制探析
法作为社会控制的手段，必须规定各种利益的分配，平衡各种利益，甚至在某种程度上还是各种不同利益相互平衡和妥协的产物。因此利益平衡机制应当被看作是知识产权法的内在价值构造。自知识产权制度建立以来，利益平衡一直是其追求的价值目标，知识产权法的诸多原则和规则背后，反映了协调和解决知识产权人和社会公众之间利益冲突的思想。
一、 我国知识产权海关保护现状
我国自《知识产权海关保护条例》颁布以来，通过不断完善，已经逐步建立起了一套包括对侵权主体进行行政刑事处罚以及对侵权货物进行相应处置等环节在内的系统的、完善的知识产权海关执法制度。目前，我国仍是世界上为数不多的主动在出口环节实施知识产权海关保护的国家之一。在2011年，我国海关共扣留进出口侵犯知识产权货物1.8万多批，共计1、03亿件，涉及商品价值达人民币5.16亿元。同年，我国海关获得了2011年“全球反假冒最佳政府机构奖”,由全球反假冒组织颁发。可见，我国政府用实际行动向国际社会彰显了坚决抵制侵权货物进出口的有力决心。 知识产权海关保护的利益平衡机制探析:http://www.751com.cn/faxue/lunwen_47183.html
