摘 要：我国目前普遍存在宅基地流转私下交易的现象，进而出现了宅基地流转的隐形市场。而当前法律法规对买卖宅基地的禁止，凸显了中国法律和制度与城市化、经济发展在宅基地流转方面的不相适应。农村稳定是社会稳定的根基，我们要重视农村宅基地在流转过程中存在的问题。因此本文对农村宅基地转让制度进行大胆的设想，从建立农村宅基地动态信息系统的角度出发，制定合理并且有条件的流转制度。通过建立农村宅基地市场交易机制来实现流转的合法化，并积极探索，确保发挥土地最大效益。从而改善农民生产生活条件，维护社会的稳定。55792

Abstract: China is currently widespread phenomenon residential land in private transactions, and thus appeared residential land stealth market. But the current policy prohibits trading  homestead laws and regulations, highlighting homestead circulation does not adapt in Chinese laws、regulations、urbanization and economic development . Rural stability is the foundation of social stability, we should pay attention to the problems of rural homestead in the transfer process. Therefore, the paper transfer system for the rural homestead bold vision .We can develop a reasonable and conditional transfer system from the point of building a dynamic information system of rural homestead. To achieve the transfer of legalization, we can establish rural homestead circulation of market mechanism. It can ensure maximum profit land by active exploration, which can improve the production and living conditions of farmers .

1　前言

我国是农业大国，农村集体土地对于集体和农民来说具有重要意义。1农村宅基地作为农村居民的住宅用地，是广大农民最基本的生活资料，是农村土地的重要组成，也是我国物权制度中一种特殊的物权形式。我国现行法律基于保护农村土地的目的，防止转让房屋和农村建设用地后丧失住所的价值考量，严格限制农村宅基地的自由流转。

2  农村宅基地流转的现状

我国宅基地流转制度是在1979年家庭联产承包制建立之后形成的。根据我国相关法律规定，农村宅基地属于农村集体所有，农民虽然享有无偿并且无限期的使用权，但是农村宅基地的流转却受到很大的限制。2
