摘要：纵观各国的刑罚体系，社区矫正制度已成为世界各国刑罚体系改革的趋势。社区矫正制度的践行，克服了监禁刑的弊端，给予服刑人员一定的自由，充分体现了现代刑罚中尊重与保障人权的理念。文章从社区矫正的基本理论出发，首先介绍了社区矫正的起源与发展，并详细的叙述了我国社区矫正的发展历程。其次论述了我国社区矫正的现状，并从中总结该制度的不足。最后，作为写作的重点，笔者从立法、扩大社区矫正的适用范围、完善出狱人的保护救济、提高工作人员素质、建立专门的社区矫正经费制度等方面切入，论述如何完善我国社区矫正制度。56913

Abstract:The penalty system, community correction system has become the trend of the penalty system reform in the world. 一、引言

社区矫正制度是一种与监禁刑相对的，新型的行刑方式。社区矫正理念起源于19世纪末近代学派的行刑社会化思想，从此社区矫正思想在西方国家逐步发展。目前，社区矫正已经成为西方国家占主导地位的行刑方式，且逐步成为世界各国刑罚体系改革发展的趋势。我国为顺应国际刑罚改革的发展，2002年在北京和上海进行了社区矫正的试点，从此，我国开始了社区矫正的中国化进程。2012年，社区矫正制度纳入刑法，标志着我国社区矫正制度的初步构建已经形成。 论我国社区矫正制度的不足与完善:http://www.751com.cn/faxue/lunwen_61495.html
