摘 要：我国的民事诉讼法起步较晚，许多的制度并不完善，其中的无独立请求权第三人制度更是因为没有明确规定第三人的诉讼地位、参诉方式等成为学术界争议的焦点，在具体的实践中,无独立请求权第三人往往被动的参加诉讼，权益受到侵害。这篇文章从无独立请求权第三人的概念、特征着手，与国外有关诉讼第三人制度比较分析，揭露立法和实践中存在的问题，提出在保护其权益上的几点见解，希望能够尽自己的一份力去保护无独立请求权第三人的权益。65733

Abstract：The civil procedure law of our country starts late, many of the system is not perfect, without independent right of claim of a third party system is a suit to a third person because there is no clear position, and v. way become the focus of academic debate, in the concrete practice, no independent claim the rights and interests of a third person can not get good protection. Starting from the concept to a third party without independent right of claim, characteristics, compared with foreign related litigation system of the third person analysis, reveals the problems existing in the legislation and practice, summed up to the third party rights and interests protection without independent right of claim of several Suggestions, hope no independent claim to protect the legitimate rights and interests of a third person a hand.

1 引言

无独立请求权第三人制度在民讼法中拥有很重要的地位，然则法律上的规定过于简单，理解上就会引起分歧偏差，滥列无独立请求权第三人的情况经常出现，这践踏了法律的公平、公正，无独立请求权第三人往往成为被侵害的主体。本文研究的重点在于怎样更好的去维护其权益，通过借鉴国外制度中好的方面，对比发现我国制度上存在的主要问题，提出自己浅显的看法。

2 无独立请求权第三人内涵辨析
