摘要:近年来,随着我国城市化水平的逐步提高,建设用地供需矛盾日益突出。为了缓解土地供需矛盾,客观上需要集体经营性建设用地入市流转。2013年10月,中央在政策层面提出了土地制度改革的方向:构建城乡统一的建设用地市场,赋予农民更多的主动权,保障农民能够通过集体建设经营性建设入市分享到城镇化、工业化带来的丰硕成果。2017年2月,中央一号文件明确提出集体经营性建设用地入市。通过发挥市场机制的作用提高土地资源的配置效率;通过完善土地收益分配的机制、土地税收体系,实现土地收益在国家、集体、个人之间的公平分配。
改革试点虽然积累了经验但仍有缺点,受到诸多因素影响,探索过程中的收益分配仍然存在分配主体不一致、分配方式不合理、分配比例不合理等问题。农村集体产权模糊、基层制度安排不健全,致使农民权益受损害。这些问题已成为当前土地领域亟需解决的问题。因此,本文通过从理论上解释集体建设用地入市收益分配过程中存在的各种问题,综合产权理论、地租理论、税收理论等相关理论,结合试点地区案例分析,为土地收益实践提供理论解释及参考意见。29020
