摘 要：随着我国社会主义市场经济的高速发展，制约我国农业发展的问题日益显现，成为中国经济发展一大短板，也阻碍了农民生活水平的提高。城镇化进程的加快，使大量农村劳动力流失，由此引发了“三农”发展的诸多问题。但与此同时，也为农村土地承包经营权抵押制度的发展提供了良好的土壤，迎来农业发展革新的大好时机。本文以“农村土地承包经营权抵押”作为论题的切入点，依据我国现行相关法律和政策，通过探讨现实中我国农业发展的相关情况和理论界的观点，分析了我国发展农村土地承包经营权抵押制度的利弊，希望为土地承包经营权抵押这一问题提供有益之策。62574

Abstract: With the rapid development of China's socialist market economy, restricting China's agricultural development is increasingly apparent, the Chinese economy has become a big short board, also hindered the improvement of living standards of farmers. 2015年三月，新疆维吾尔自治区博乐市乌图布拉格镇农民杨保国，通过当地农商银行，用7000亩地的土地经营权抵押，贷款了2000万元，解决了其缺少发展资金的燃眉之急。随着我国农业大发展的推进，越来越多的农民期望以手中最大的财富——土地，来获取其发展生产所急需的资金。当今，我国社会经济发展正处于转型的历史阶段，陈旧的制度和法律已不能满足社会的需求。解放思想、稳中求进、改革创新是党在这个新阶段为“三农”发展提出的工作路线，2014年中央、国务院公布的《关于全面深化农村改革加快推进农业现代化的若干意见》中，深化农村土地制度改革成为一项工作重点，在文件中允许以土地的承包经营权进行抵押这一内容为今后的立法以及制度的创新指明了方向。伴随各地试点信息的反馈，土地承包经营权抵押相关制度的建立和立法工作的开展，已然迫在眉睫，农村“沉睡的资本”，正在渐渐苏醒。由土地承包经营权抵押引出的法学问题，也在法学界内得到了广泛研讨。
