摘要：上个世纪80年代开始，在经济全球化过程逐渐加快的大浪潮下，世界各国的经济和贸易越来越相互依存，同时，国与国之间的摩擦与冲突也愈演愈烈。我国自然也是不能避免，其中最主要的是与美国之间的冲突。而这其中，中美知识产权摩擦逐渐成为其重心所在，过去几年里，我国企业多次经历美国知识产权方面的“337”调查，中国已然成为美国知识产权调查最主要的审查对象和最大受害国。现阶段，不管是我国政府还是美国政府都已经意识到了在彼此的贸易往来中，知识产权问题对两国经济贸易的发展存在着重大的影响。所以，不论是从与国际接轨需要的角度，还是从我国自己需要的角度，改善知识产权保护的环境都是十分迫切且必要的。本文在借鉴了相关文献的基础上，全面分析了中美贸易摩擦中知识产权纠纷的现状，演变过程及形成原因等，同时也针对性地提出了一些建设性的解决策略。39060

Discussion on the issue of intellectual property disputes in Sino-US trade friction
Abstract：The last century, the 1980s, gradually accelerating economic globalization, big wave, increasingly interdependent and dependent countries in the world, friction and conflict between countries has intensified. And this one, the Sino-US IPR friction gradually become the center of gravity is located, in the past few years, our business has experienced many aspects of Section 337 of US intellectual property, China has become a major US investigation of intellectual property. This has become the main obstacle Chinese exports to the US companies. At this stage, whether it is the government or the US government have been aware of the two countries in trade, intellectual property issues for the development of bilateral economic and trade there is a significant impact. the perspective of our own needs, improve IPR protection environment it is very urgent and necessary. This paper draws on the literature on the basis of a comprehensive analysis of the current situation of intellectual property disputes in Sino-US trade friction, evolution and causes, etc., but also put forward some constructive resolution strategies.
