摘要同性恋现象的存在普遍且广泛，社会对同性恋的认识经历了从罪到非罪、病到非病的演变，而随着近代以来对同性恋问题的研究和平等自由人权等观念的普及，西方各国的同性恋者掀起了轰轰烈烈的同性恋平权运动，这促使了同性恋者主体意识的觉醒，他们开始提出同性婚姻的诉求，以期得到社会和法律的认可。现今社会不断发展进步，人们的法律意识逐渐增强，对保障人权的要求也日渐提高，价值观念的多元化发展也使得人们逐渐接纳、认可同性恋及同性婚姻，基于特定的条件，部分国家和地区完成了相关立法，实现了同性婚姻合法化。笔者认为同性婚姻合法化将成为社会发展的必然趋势，但我国的同性婚姻合法化道路必然漫长，不能一步到位，需要循序渐进。近几年来，关于同性恋问题、同性婚姻问题的研究喷井式涌现，但从立法的可行性层面研究同性婚姻合法化的成果却有所欠缺。本文拟通过文献研究的方法寻找同性婚姻合法化的理论依据以论证其正当性，通过比较研究的方法学习各国的立法模式为我国同性婚姻合法化进程提供有益借鉴，通过实证研究的方法立足我国实际分析同性婚姻合法化的必要性，全面深入了解同性婚姻领域存在的法律问题，对我国相关立法的可行性问题做重点研究，提供婚姻家庭法律制度完善的基本思路和方法。33137

Abstract
The existence of homosexuality is generally and widely.the understanding of homosexualityin social have changed from guilty and sick to not.But with the popularization of the human rights such as freedom and equality,it has showed many studies ofhomosexuality since modern time.Gays and lesbians in western countries presented a vigorous gay rights movement,which led to their awakening of subject consciousness.They began to appeal of same-sex marriage,expecting to get social and legal approval.With the development of the social,the legal consciousness of people has greatly strengthened and the demand for protecting human rights are increasingly improved.The persification of value ideas makes it possible for people to accept homosexuality and same-sex marriage.Based on some specific conditions,several national and regional finished the legislation, realized the same-sex marriage.I thinks that same-sex marriage will become the inevitable trend of social development.But we need to step by step for legalizing gay marriage in China is still a long way off.For these years,researchs on gay and gay marriage problems have a large quantities. But from the aspect of legislation, the feasibility of the research results of same-sex marriage is lacking.This article tried to use literature review methods to find the theory basis of same-sex marriage to prove its legitimacy.Learning other countries legislation mode by using the method of comparative study provides beneficial reference for process of our legal recognition to same-sex marriage.we should analysis of the necessity of same-sex marriage Based on the reality of our country by using the method of empirical research,which can be helped in understanding of legal problems in same-sex marriage.All of this focus on the feasibility of the question to the related legislation of our country and provide basic ideas and methods of the marriage and family law system perfect.
