[摘 要]2004年发生的春晓油气田事件，将中日东海大陆架划界争端再一次推向了风口浪尖。中日东海大陆架划界争端不仅是政治问题也是法律问题，运用国际法学理论分析该问题，从法律理论上获取自身主张的合理性和合法性是不可回避且极其重要的环节。中日双方的根本分歧体现在划界原则上。此外，在冲绳海槽的效力、钓鱼岛的划界效力以及“冲之鸟”的岛礁认定这些问题上，中日双方也存在不小的争议。以争端的根本分歧以及争端涉及的关键因素为突破口加以分析，结合国际公法相关的历史判例以及中日两国国内的政策主张可以得出中日东海大陆架划界争端的轮廓，进而分别从短期和长期角度以公平文护两国国家主权利益得出具有一定建设性意义的建议。34583

Analysis of Legal Issue to the Sino—Japanese East Sea Continental Shelf Delimitation
[Abstract]In 2004,the discovery and exploitation of China in Chunxiao Oil and Gas Field, as a blasting fuse ,highlighted the dispute again concerning the delimitation of the continental shelf at the East Sea between China and Japan.The dispute is not only a political issue but also a law and jurisprudence issue.Thus,it is an inevitable study, which brings out the rationality and validity of claims, to analyze this “issue” based on the public international law theory.The fundamental pergence of this dispute centers on the principle of delimitation.The legal force of Okinawa Trough, the effect on delimitation of Diaoyu Island and the question of whether Okinotorishima is an island or not are all the key points. Analyzing the above key fabrics together with the reference of worldwide recognized methodologies and real cases , what this bilateral dispute is actually like can be sketched out.Finally,some constructive suggestions both in the short and long term can be obtained .
