【摘要】无线电频谱资源是信息社会中重要且不可替代的战略性资源，由于其资源本身的稀缺性，再加上人类社会在不断发展过程中对其需求量的不断扩大，无线电行业对无线电频谱资源的争夺越来越激烈。究其原因，除了技术本身障碍之外，有关法律、法规的缺失和管理制度的不完善，也是造成的无线电频谱资源利用率低的重要原因。自《物权法》颁布以来，无线电频谱资源在民法王国的后花园中似才有了一席之位，但也由此引起了学界对于其法律属性的又一轮争议。因此，笔者认为在立足于各国对无线电立法的基础之上，联系我国无线电频谱资源的使用状况，加强对无线电频谱资源相关法律制度的研究已经是一项刻不容缓的任务了。因此，本文将首先确定无线电频谱资源是“资源”这一属性，进而论证资源为“物”，以此确定其属性，最后方可谈其归于物所有的使用权制度及其存在的问题和相关建议。34847

ABSTRACT
Radio frequency spectrum resources is important and irreplaceable strategic resources in the information society, with the development of science and technology, wireless technology has been widely applied in many areas of the society.But at the same time, competition is increasingly fierce of all kinds of wireless technologies and application -s, resulting in the demand for radio frequency spectrum resources expanding rapidly. The reasons that making the technical barrier in itself in addition to the lack of relevant laws and regulations and management systems are not perfect, and these also contribute to the low use of radio frequency spectrum resources.Ever since the enactment of the <Property Law>, radio frequency spectrum resources seem have had a seat in the back garden of the Kingdom of civil law,which resulting circles for its legal property of yet another round of controversy.Therefore, I believe that in General on the basis of national legislation on the radio, our usage of the radio spectrum resources to strengthen research on radio frequency spectrum resources related legal system has been an urgent task.Therefore, this paper will first determine the radio frequency spectrum resource and prove it is "resource", so as to prove the resources to "objects", in order to determine its properties, the last before they can talk about their attribution to the regime and the existence of the right of all of the issues and related recommendations.
