摘 要：在现实生活中，因夫妻一方擅自处分共同财产的行为而引发的纠纷十分常见，且不论是理论还是实务都注重交易相对人利益的保护导致了在对夫妻隐名共有人的利益保护上有所欠缺。而对于此种行为引发的法律上的争议主要有夫妻单方处分行为的性质问题，对此应区分两种情形，若夫妻一方以自己的名义处分共有房屋，则是无权处分；若以夫妻双方的名义处分则是无权代理。对于夫妻一方与善意买受人所订立的合同效力问题，我国物权法既然明确了区分原则，则应认定合同有效。总之，只有妥善处理好夫妻单方处分共有房屋所引发的法律问题，才能实现双方利益保护上的平衡。40774

Research on Legal Issues of Unauthorized Disposition of Common House
Abstract: In real life, because one of the spouses of unauthorized disposition of common property behavior is very common. The problem is, the present legislation of our country on the protection of interests of dormant co-owner still exist deficiencies. The nature of the problem about this behavior should distinguish two kinds of situations: If one of the spouses’ disposition of common housing in their own name, it is the unauthorized disposition; if in the name of the couple, it is the unauthorized agency. And for the validity of contract between one of spouses and the opposite person in good intentions, we can’t simply apply the rule of unauthorized disposition to define the effectiveness of the contract. The property law in China since set the the principle of distinction,the contract shall be deemed valid.For the third person in good faith on the basis of the system of bona fide acquisition for protection when needed to clear criteria for identification of "good faith".Therefore, Only properly deal with the legal issues that arising from the act of disposition without authorization , can realize the balance of the bilateral interest’s protection.

夫妻单方处分共有房屋法律问题研究 前 言
如今，人们的生活水平不断提高、家庭财富也不断积累，导致二手房交易活动异常活跃。由此产生了夫妻单方处分共有房屋的现象时有发生，这将对家庭关系的和睦产生难以估量的影响。甚至影响到实践中买方的利益及整个市场交易的动态安全。对此问题，我国立法也进行了一些指导，根据2011年施行的《婚姻法解释（三）》第11 条的规定，首先侧重于对善意第三人的保护，其次也在一定程度上保护了夫妻另一方的权益。然而这对现实中出现的各种复杂情况的指导力度显然不够，而且也导致了法律保护上的不公。夫妻财产关系不同于其他社会财产关系，需要在充分保护到交易相对人利益的同时，也能使夫妻隐名共有人的利益得到保护。因此，只有考虑通过实践中出现的问题，希望通过对夫妻单方处分共有房屋行为中涉及的法律问题进行研究，从而对立法的完善提出一己之见。 夫妻单方处分共有房屋法律问题研究:http://www.751com.cn/faxue/lunwen_39197.html
