摘要：同人乃是一种二次创作的作品，即对同人作品的一般称呼。随着互联网时代的到来以及东西方文化的迅速交融，同人作品如今十分流行，但它同时也因为自身的定义而在道德以及作品的知识产权方面面临着困扰指责。因此，突破同人作品的发展瓶颈期，保证其生存并进一步促进同人的发展成为我国出版社必须解决的一大问题。本论文采用理论与实践相结合的方法，在综合分析国内外有关同人作品的相关案例的基础上，对二次创作作品与原作之间的冲突进行分析，明确二次创作作品的法律地位及权限，实现二次创作作品以及原作的共同发展，以促进文化传播和发展以及法益优先和利益平衡的角度，来引导同人作品健康有序发展。43686

The publication status of fan fiction and Intellectual property conflict
Abstract：Colleagues but a second creation of works, namely of Fanfiction general term. With the age of the Internet and the arrival of the cultures of the East and the West rapidly blend, Fanfiction is very popular these days, but it also because its definition and in terms of moral and intellectual property right of the works facing problems accused. Therefore, to break through the bottleneck of the development of the fan works to ensure their survival and to further promote the development of fan become a great problem that must be solved in the press in our country. This article adopts the method of combining theory with practice, both at home and abroad, on the basis of case analysis, the relationship between the original works and fan works in the conflict are discussed, thus determine the scope of the legal status and rights of fan fiction. In order to promote cultural communication and development as well as the priority of legal interest and the perspective of interests balance, to guide the healthy and orderly development of fan fiction.
