摘要:随着城乡一体化的发展,农村经历了大范围的拆迁,伴随着农民获得了拆迁安置房,有些人甚至获得了数套。由此而来的安置房买卖便火了起来。但是农村拆迁安置有着多种安置类型,拆迁安置房有多重性质,其买卖合同的效力不能一概而论。对于以商品房安置的,若该商品房属于政策性商品房,属于限制交易类型,在五年内不得上市交易。若该商品房属于完全商品房,买卖合同有效;对于以“小产权房”安置的,其买卖行为不符合条件,一般认定为无效;对于以自建房屋安置的,当买卖双方都是农户时,其买卖合同为有效,当买卖双方当事人一方是本集体经济组织成员,一方是城市居民时,买卖合同效力有“有效说”和“无效说”之分。同时应该完善法律制度,建立一整套适合农村拆迁安置房屋买卖的规则和机制,减少合同纠纷。53024

Abstract:With the development of urban-rural integration, countryside has been going through a large scale of eminent domain. Farmers got their resettlement houses, some of who even got two or three of those houses, whereby rises up houses’ transaction. However, with various kinds and natures of eminent domain and resettlement house, the validity of contract note can not be considered as a whole. For those settled with commodity house, if it belongs to policy-related one that its trading right is limited, it can not be listed within five years; while if it is the none policy-related one, its contract note is valid. For those settled with small property right house which is ineligible, it is generally treated as invalid. As those settled with self-built house, when both parties are peasant households, its contract note is valid; when one party is the peasant household, another one is the urban household, its contract note will be distinguished with valid and invalid. Our country should improve the legal system to set up a series of rule that suitable for the trade of eminent domain and resettlement rural house for the decrease of contract disputes.
