摘 要：随着科学技术的发展，人们对于信息的需求逐渐增大，越来越多的虚假信息充斥了网民的生活空间。由于人们对网络信息的真伪难以辨认，加之政府不能及时有效地进行引导，在认知不足的情形下，网络谣言得以日益蔓延。然而处理网络谣言，不能一概而论，必须从诽谤的对象、动机和所造成的实际后果进行辨析，避免对网络谣言的处理中损害了言论自由的空间。针对近期网络谣言的频发以及出台的《网络诽谤解释》，对于争议较大的寻衅滋事罪的成立与不足，以及治理网络谣言的思路，进行必要的剖析，使得网络谣言得以规范。65034

Abstract：With the development of science and technology，The need for information is increasing.More and more false information is filled with the living space of Internet users.Because of the hard identification of the authenticity of the network information, and the government can not guide the timely and effective, in the case of the lack of awareness, the network rumors can spread.However Internet rumors, cannot treat as the same consequences. The object of libel, motivation and the resulting from the analysis to avoid of network rumor damage the space of freedom of speech.For the frequent occurrence of the recent rumors of the network and Promulgated “Network defamation interpretation”，for more controversial crime of creating trouble establishment and shortcomings, and thinking Governance Network rumors, make the necessary analysis, making the network rumors to specification.

从备受关注的秦火火案，到中石化“非洲牛郎门”，日益蔓延的网络谣言犯罪逐渐成为社会争论的热点，在传统的寻衅滋事罪的制裁中对网络造谣案件的处理显得格外尴尬，尤其两高《网络诽谤解释》尤为学者所诟病，以寻衅滋事罪作为标准判决，究竟是传统口袋罪向网络空间的扩张，还是传统法律规则向网络空间的适时延伸，是一个值得我们研究的基础性问题。对待网络谣言的态度，需要我们认真的审视，能够客观地辨析谣言，正确地处理和规范谣言，以期在网络谣言与言论自由之间找到过渡点。论文网 论网络谣言的刑法规制及完善:http://www.751com.cn/faxue/lunwen_72500.html
