摘要：我国目前的安全生产形势依然严峻复杂，尤其是重特大事故频发且危害严重。因此，社会各界的专家学者对于危害安全生产经营的典型违法行为，都表现出了强烈的刑罚诉求。2016年12月6日发布的《中央国务院关于推进安全生产领域改革发展的意见》中就明文指出，要“健全法律法规体系，将生产经营过程中极易导致重大生产安全事故的违法行为列入刑法调整范围。”本文对我国生产经营过程中典型违法行为入刑的必要性、正当性和可行性进行探究并提出理论上的支持，对生产经营过程中典型违法行为入刑的构成要件与量刑进行研究，提出我国生产经营过程中可入刑的典型违法行为，对我国生产经营过程中典型违法行为入刑后部分法律条文提出修订意见，对配套的安全监察体系进行探讨。69792
