摘要随着经济全球化的深化，凸显出许多新的社会问题。国际软法作为一个新兴领域，为处理此类为题开辟了新的道路。在一些相关的基本问题上，诸如国际软法的规则属性、效力、功能实效问题，学者们各执一词。国际软法理论研究的发展因此受到了不好的影响，国际软法解决实际问题的实践也因此收到了影响。因而，进一步深化对国际软法的研究在理论和实践两方面都具有重要的意义。 国际软法随着实践的深入，其发挥出日益重要的作用，获得了不亚于硬法的约束力。将其剔除在传统的法律范畴之外不再合适，国际软法和国际硬法优势互补，一同发挥其作用是将来的必然趋势。传统上，国际软法具有证明国际习惯，补充硬法不足，协调国际争端，提高国际共识的作用。但随着实践的深入，国际软法也获得了新的发展。一方面获得足够强制力的软法得到了近似硬法的地位，另一方面软法成为了国家间进行利益斗争的工具。软法获得的新功能也对国际法律环境产生了影响，首先在某些领域硬法逐渐被具有足够约束力又更加灵活高效低成本的软法所取代，其次软法成为影响国家软实力的重要因素。 30785

It to a certain extent influence the development of the theory of international soft law, which affect the international progress of soft law to solve practical problems. Therefore, strengthening the international soft law research has very important theoretical and practical significance. 1 引言 全球化进程在进入 21世纪以来始终处于不断强化中。全球化消弭了国家间经贸领域的藩篱，带来了投资贸易等方面的便利和自由。然而全球化也使得许多新的国际问题凸显出来。当今的国际社会，面临许多全球性的问题，如全球暖化，大气污染等。处理这类世界性问题不单单要求主权国家进一步强化相互之间的协作，， 也不能没有诸如国际组织等非国家主体的共同努力。在全球化时代，规范国际社会诸多主体的是规则。在文护国际法律秩序上，习惯法和国际法这类硬法起到不可替代的重要作用。方兴未艾的国际软法亦能在全球化问题的解决中发挥积极作用，填补了国际法律体系的漏洞和不足。1 在国际软法日益重要的今天，对这种特殊的法律规范，法学界也进行了深入的研究和探索。尽管对国际软法的研究越来越深入，但是争议与疑问仍然存在。首先，对国际软法的规则属性问题，学界有着较大争议，软法是否是法仍没有明确的结论；其次，对于国际软法的效力，学者们对其是否有足够约束力亦未达成共识；再次，对国际软法的功能实效，随着实践已经有了新的发展。在现今国际秩序中，国际软法的功能定位究竟如何，成为亟待解决的问题。 本研究从国际软法的功能依据入手，分析了国际软法的规则属性问题和强制约束力问题，由此得知国际软法之应然作用。再通过对实践案例的探讨，研究国际软法功能的新发展，并由此得到国际软法的功能效应。 论国际软法的功能定位+文献综述:http://www.751com.cn/faxue/lunwen_26686.html
