广东省新生代农民工劳动权益保护问题

摘要伴随着我国城市化水平的高速发展,由80后、90后组成的新生代农民工逐渐成为农民工群体的主力军，然而他们的许多劳动权益却得不到充分保障。本文针对广东省人口城镇化水平的快速发展，通过问卷调查得出广东省新生代农民工劳动权益保护现状主要体现在：劳动合同签订率不高；劳动报酬权得不到保障；休息休假权受到侵害；职业安全隐患更加复杂；缺乏职业技能培训；社会保险缺失等。从法律、社会、政府、市场和个人等方面深入分析新生代农民工劳动权益缺失的原因，并据此提出改善其劳动权益保护的有效性建议是：建立和完善多层次的劳动法律法规；深化二元户籍制度改革；发挥工会和非政府组织的维权能力；加大政府执法普法的力度；建立完善的职业技能培训体系。45832

Abstract
Along with the deepening of China's rapid development of urbanization, the new generation migrant workers is composed of people who born on 80’s and 90’s have gradually become the main force of migrant workers. However, many of their labor rights and interests are not fully protected. For the rapid development of the level of demographic urbanization of Guangdong Province, this paper used the method of questionnaire survey to discusses the present situation of the new generation migrant workers on labor rights reflected in:low labor contract rate, labor remuneration right is not guaranteed, violations of the right to rest and vacation, occupation safety is more complex, the lack of occupation skill training, the lack of social insurance. In-depth analysis of the reasons for the new generation of migrant workers labor rights and interests from legal, social, government, market and inpidual etc. And puts forward some effective suggestions to improve the protection of labor rights is: to establish and perfect the multi-level labor laws and regulations, to deepen the reform of the household registration system of two yuan, the role of trade unions and non-governmental organizations the ability of safeguarding rights, to increase government ’s law enforcement efforts, to establish occupation skill training system.
