论摄影作品的著作权与肖像权的冲突及其解决途径

摘要：法制进程的不断加快，社会生活日益丰富，公民的维权意识随之加强，权利冲突逐渐成为普遍。很多过去隐而未现的法律争议冲突也随着诸多现象浮上水面。本文拟从实践中所含的摄影业经营者的摄影作品著作权与消费者个人肖像权的冲突方面进行探讨，以期对著作权与肖像权冲突的解决与具体实践中法律条文能对此有所重视做出自己的微博之力。此处的摄影作品（只讨论委托他人为自己拍摄照片的情形），则关于摄影作品权利归属的争议与处理意见，即委托他人为自己拍摄照片情况下的作品相关权利的的冲突与解决途径。中国的《著作权法》以法律形式固定了肖像作品的著作权,与此同时《民法通则》也以法律形式固定了公民的肖像权,由于肖像权是以物质载体的形式存在的，一般表现为作品，例如照片，画像等，因此在一副肖像作品上，实践中两者在具体行使权利的过程中，交叉和冲突已经成为常态。56708
