摘要地方政府决策损害中小型民营企业的利益在国内屡见不鲜。本文通过对中小企业在因地方政府决策而造成合法利益受损时而采取的体制内和体制外抗争行为进行全面系统的调查与分析，探讨企业在因政府行政决策利益受损时而采取的抗争行为的类型、策略、特征及影响因素和产生原因等。并以安徽省在禁止烟花爆竹生产中，中小型民营企业维护自身合法权益的抗争行为为案例展开具体研究，通过分析安徽省烟花爆竹企业在维护自身权益时遇到的困难和问题，论证当前体制内中小企业维权机制是否切实有效，并探索如何进行制度优化完善中小企业的维权机制，如何通过制度创新来拓宽中小企业的维权通道，以保障中小企业主的合法权益，化解利益矛盾，解决社会冲突，维护社会稳定。最后，本文提出了优化完善现有体制内抗争行为和创新吸纳体制外抗争行为，充分发挥体制外抗争行为的优势，以维护中小企业的合法利益的政策建议。 48668

Finally, this paper optimize the sound within the existing system behavior and innovation to absorb protest protest outside the system behavior, give full play to the advantages conduct protest outside the system, in order to safeguard the legitimate interests of SMEs policy recommendations.
