摘要随着互联网的发展，网民数量的急剧增长，“人肉搜索”作为全新的搜索工具出现在网络上。由于传统媒介的滞后性，舆论监督方面的失语，以及网络行为缺少规制等，这些因素致使“人肉搜索”的兴起。但是，“人肉搜索”也具有两面性，既可以检举犯罪，维护社会zhuyi，也可以随意侵犯他人的权利，模糊了法律与道德的界限。因为涉及到他人的名誉权、隐私权、肖像权等，这急需法律的规制。但由于网络服务者的不审查行为、政府监管缺失以及立法空白的因素，遇到的阻碍还是比较的多。通过对国外相关立法制度的理解，我们可以从中得到许多借鉴，为我国立法提供经验。同时，在司法事件中，也因平衡公众利益和个人权利，切不可为了公众利益侵犯个人权利。67214

Title “Human flesh search” legal issues of research
Abstract
With the development of the Internet, the rapid growth of the number of Internet users, "human flesh search" as the new search tool on the web. Due to the lack of regulation of traditional media lag, the aphasia of supervision by public opinion, as well as network behavior, these factors resulted in the rise of the "human flesh search". However, the "human flesh search" has two sides, either prosecution of crimes, safeguard the socialist, are free to infringe the rights of others, blurring the boundaries of law and morality. Because it involves others the right of reputation, privacy, portrait rights, which are in urgent need of legal regulation. However, due to not review the behavior of the network services, lack of government regulation and legislative gaps factors, obstacles encountered or more. Understanding of foreign legislative system, we can derive many lessons and experience for our legislation. Meanwhile, in the event of Justice, but also because of the balance between public interest and inpidual rights, must not infringe the rights of the inpidual in the public interest.

1 引言
随着互联网的兴起，网络日益融入到社会日常生活中，网络名词和网络事件也层出不穷，近年来，有一种叫做“人肉搜索”的网络行为方式流行起来，最早起源于猫扑网，先是由网友提供图片，音频以及视频等相关线索，并且悬赏相应的猫扑币（猫扑网的虚拟货币），希望能够得知事件中当事人的具体资料，其他网友则通过“百度”，“谷歌”等搜索引擎和“微博”，“人人网”，“朋友网”等关系网站，通过类似场景搜索，或者关键字搜索，在个人或者众人通力合作下，通过信息比对和信息汇总，然后获得最终所需要的结果。这种搜索方式不同于以往机器搜索，而是包含了人力在其中，所以叫“人肉搜索”。但由于新事物的出现必定有两面性，往往会出现一系列的法律问题。来~自^751论+文.网www.751com.cn/
