摘要随着新生物技术和现代医学技术的发展以及社会政策的变化，胎儿利益的保护问题变得更加复杂。目前我国理论界对此研究尚不够深入，相应地关于胎儿的民事立法也较少，对于实际生活中发生的大量的胎儿索赔纠纷，找不到相应的法律依据。因此，我们很有必要在理论上对胎儿利益保护问题进行研究，尤其应加强对胎儿损害赔偿请求权的研究。本文分以下几部分进行探讨、研究：第一部分为胎儿损害赔偿请求权概述；第二部分主要探讨胎儿损害赔偿请求权的理论基础。第三部分为比较法上的考察；第四部分为我国立法的现状、缺失与完善。笔者期望本文的研究能对促进我国加快胎儿利益保护立法有所裨益。笔者相信，随着我国社会zhuyi市场经济的不断发展，随着社会zhuyi法制的日益完善，胎儿利益必将受到越来越周密的保护，强化对胎儿的保护，顺乎人情及民法进步之潮流。68225

Title Fetus Injury Compensation Request Right
Abstract
With the development of new biotechnology and modem medical technology as well as the changes in social policies，the issue of protecting the interests of fetus has become more complex．Presently,the theoretical research thereof in China is not in-depth,and accordingly,the legislation concerning fetus is far from sufficient,with no relevant legal bases available for the large number of disputes arising from the claims against fetus injury in the practical life．Therefore，it is of great necessity to researh theoretically on protecting the interests of fetus,particularly the claims against fetus injury. This paper covers the following parts：The first part covers the definition for the legal concept of fetus; In the second part,the theoretical basis for the claim against fetus injury is mainly discussed,which is the main part of this paper．The third part is an investigation into comparative law. The fourth part covers the present situation and shortcomings of the legislation in China．It is hoped that the research in this paper will have some help in promoting the legislation over protecting the interests of fetus in China．The author believes that with the continuous development ofthe socialist market economy in China as well as the increasing perfection of the socialist legal system,the interests of fetus will get better and better protection；and the protection OVer fetus will be enhanced toconform to the human feelings and the progress of civil law．
