摘要:随着社会经济的不断发展, 劳资关系的协调越来越引起政府的关注,劳动关系的和谐,不仅影响着劳资双方的切身利益,同时也影响着经济与社会的健康发展。本文通过文献法、访谈法、问卷调查等方法调研工会角色的现状,发现工会在经济、人事等方面缺乏独立性;工会在发展过程中遇到阻碍,如工会的组建率、入会率不高,工会角色的认知度不高等;劳动关系中工会角色定位的相关法律体系不完善等问题。鉴于此,结合相关理论知识,借鉴国外成功经验,结合本国国情,提出相应的解决对策,包括:通过法律手段确保工会的独立性;疏通工会发展过程中遇到的阻碍 ,一方面提高工会的组建率、入会率。另一方面加大宣传力度,提升群众对工会角色的认知度;完善相关法律体系,明确劳动关系中的工会角色定位等等。唯有通过法制化手段转变工会的角色,用法律来作为工会维权路上的保护伞,才可能对工会实践中的一些突出问题提供解决方法,工会的维权职能才可能得到真正的最大化发挥,广大劳动者的合法权益才可能得到有效地保护。42846

Consummating the Definition of Trade Union in Labor and Capital Relationships by Referring to Abroad Experience
Abstract: With the development of the economy and society, the coordination between labor and capital is increasingly stressed by government, which concern the interest of workers and companies, refer to the harmony development of the economy and society. Investigating current situation of trade unions by using literature search method, interviewing method and questionnaire survey method, many problems such as low rate of organization, participation and propagation of trade union are uncovered. Basing on the knowledge and referring to abroad beneficial experience, combining with the situation of our nation, we made following suggestions: Ensuring the independence of trade union by legislative measures; Breaking through the restriction on the development of trade union by improving the organization and participation rate of trade union and propagating trade union to optimize sense of identify; Consummating concerned law system, making the definition of trade union between labor and capital explicit ect. Only with transferring trade union role by legislative approach, regarding
law as the protection to maintain rights of trade union, extrusive problems in trade union practice will be resolved, the maximized function of maintaining rights of trade union will be exert, thus, the legal rights of workers will be maintained effectively.
