摘要:伴随着我国的城镇化、工业化、市场化以及现代化的进程不断加快,大量的农民工为了更高的收入涌入到了城市中,农民工的劳动关系规范问题也日益的突出。在劳动过程中,由于不规范的劳动关系使得他们的基本权益受到了极大的侵害,诸如劳动报酬权、休息休假权、社会保障权等劳动权益得不到充分保障,由此所引发的基本权益保障问题已成为了影响社会经济发展的重要因素。对于这种不规范的劳动关系的处理是本文所研究的关键。本文将通过访谈及案例的分析来了解我国农民工劳动关系不规范的具体内容,从而以此为基础来探讨对当今社会中这种不规范的现象的应对对策。本文认为,要对农民工的劳动关系进行规范,首先,应完善相应的法律法规,使之能够从根本上保障到农民工的劳动关系问题;其次,要提高农民工自身的知识水平,做到能够正确的了解《劳动合同法》的内容,能够有意识地去规范自身的劳动关系情况;此外,加强对企业的监管与监督,从源头上杜绝不规范的劳动行为的发生;最后,建立完善的属于农民工自己的工会组织,让农民工能够形成自身的工会团体来保障自己的利益。42853
