摘 要：共有产权房是政府实现其在住房领域方面社会保障职能的政策，是一种有别于以往的新的按份共有形式。共有主体具有特殊性，一方是政府一方是普通的承购人。现阶段，共有产权房存在着一些法律制度等方面的问题，忽略了其运行过程中相关主体的权利义务的内容，相应的在权利人行使所有权权能时也会产生其他问题。这将对共有产权房未来的发展带来不利的影响。本文通过对共有产权房内涵的界定，分析可能出现的法律问题，理清相关问题和成因，就法律制度的完善以及相关法律的适用做简要的阐述。65817

1 前言
近日一则有关住房领域的新闻再次引起了大家的关注，即《淮安市全国共有产权住房试点工作实施方案》近日在江苏淮安市的市政府常务会议上审议通过，并开始实施。该方案也被称为保障住房的“淮安模式”升级版。而且，早在今年年初的人大会议上，李克强在2014年的政府工作报告中就提及“完善住房保障机制，以全体人民住有所居为目标……针对不同城市情况分类调控，增加中小套型商品房和共有产权住房供应，抑制投机投资性需求，促进房地产市场持续健康发展。”此后，全国各地热议“共有产权房”，讨论其各种机制如何设立，本身如何定位，如何推行及完善。一些地方政府也开始务实地推进落实这项工作。但通过收集的资料来看，更多地研究方向是定位于法律领域之外的，比如经济领域、社会管理领域等。这些研究更多的关注于“共有产权房”这一事物的经济效益、产权份额的确定、社会保障的落实等方面。它们为共有产权房住房的完善和发展起到了十分重要的理论推动作用，但也不难发现缺少从法律视角的分析研究。本文期望通过对共有产权房可能出现的相关问题进行分析，提出合理的建议，完善其运行的法律制度，从而使其在以后的运行中更好的服务于社会。 共有产权房法律问题研究:http://www.751com.cn/faxue/lunwen_73533.html
