摘要完善的工程质量保修制度，对于明晰质量保修的主体，明确保修责任的期限和方式，促进承包方加强质量管理，保护业主的合法权益，促进建筑市场的健康发展，具有十分重要的现实意义。

本文通过对国内外工程质量保修制度的整理和深入分析，对实际生活已发生的有关工程质量保修的案例进行剖析，笔者提出现行工程质量保修制度实施过程中存在工程质量保修金，保修期限设置不合理；保修制度单一；保修责任主体单一；施工企业保修意识不强；责任评定部门对责任评定过程缓慢；建设工程质量保修制度应用型人才的缺乏；监督部门对质量保修工作监督不力等问题。在此基础上，笔者运用文献分析法，比较分析等方法从推行工程质量保修保险制度、建设工程质量保修监理制度、完善质量保修制度有关保修金的规定、制定合理的质量保修期限、组建权威的责任评定机构、建立工程质量保修评价体系、提高施工企业自身的素质等角度提出完善现行工程质量保修制度的政策性建议。51590

Abstract

Perfect engineering quality guarantee system, to clear the main body of the warranty of quality, clear the duration of the warranty liability and promote the contractor to strengthen quality management, protect the legitimate rights and interests of the owner, to promote the healthy development of construction market, has very important practical significance.

In this paper, through the depth analysis of engineering of domestic and international quality guarantee system arrangement and the analysis of the case has happened in real life which related in project quality warranty cases. The author put forward the current existence of project quality guarantee system has some problems in the process of implementation. Such as: project quality warranty and the warranty period set unreasonable; Warranty system is too single; The warranty liability is subject is single; The construction enterprise service consciousness is not strong; The evaluation of responsibility with responsibility assessment department is very slowly; The lack of applied talents of construction project quality warranty system; Supervision departments is not supervise quality warranty work seriously and so on. On the basis, The author use the methods of literature analysis and the method of comparative analysis. And put forward suggestions from the implementation of project quality warranty insurance and construction quality warranty supervision system, improve the quality guarantee system of warranty gold rules, formulate reasonable quality warranty period, formation of authority and responsibility assessment mechanism, establishment of project quality warranty evaluation system, improve the construction enterprises quality are put forward to improve the existing quality warranty system.
