摘要随着我国市场经济体制的不断完善和发展,社会当中所存在的劳动关系也日益市场化和复杂化,现实生活当中随处可见有关劳动合同的解除与终止等关系。当发生这种现象的时候,随之而来的便是经济补偿问题,如果不能够妥善地处理好该问题,将极有可能会引发雇员与雇主之间的纠纷,从而不利于社会的和谐与稳定。33988
本文首先介绍了劳动合同以及经济补偿金等相关的概念,接着详细地分析了我国有关劳动合同解除或终止之后经济补偿制度的立法现状以及所存在的问题,然后在介绍了国外有关国家和地区在相关立法上的经验基础之上,针对性地提出了完善我国经济补偿制度的立法措施。即要增强约定经济补偿金规定的可操作性,完善劳动者无过错情形下的立法规定,健全和增强经济性裁员当中的工会职能,以及细化经济补偿金的计算方法。

Title The Study of Economic Compensation System for the Labor Contract
Abstract
With the development and improvement of China's market economy system, labor relations in society are also increasingly market-oriented and complex, real life can be seen everywhere on the lifting of the labor contract relationship and termination. When this happens, the attendant is the issue of economic compensation, if not properly dealt with the problem, will most likely to lead to disputes between employers and employees, which is not conducive to social harmony and stability.
This paper first introduces the concept of labor contract and economic compensation and other related, then analyzes in detail after the dissolution or termination of the labor contract legislation situation of economic compensation system and the existing problems, and then introduces the relevant foreign countries and regions in the relevant legislation on the basis of experience, put forward the the legislative measures of economic compensation system in china. To enhance agreed economic compensation provisions operability, improve workers without fault of the case under the legislation, improve and enhance economic layoffs among the functions of trade unions, and refinement of economic compensation calculation method.
